4 provisions identified: 3 benefits, 1 costs, 0 mixed.
Covered Arkansas wage access providers must offer and explain a reasonable free option whenever they offer early pay for a fee. They must disclose all fees and your rights before signup, announce major changes beforehand, and allow cancellation anytime without their own cancellation fee. Providers must promptly handle questions and complaints, follow privacy and data security laws, and deliver money through an agreed method. Providers that follow the act are not treated as lenders, money transmitters, or debt collectors solely for these services. Their services also do not violate state rules on selling, transferring, or directing payment of earned but unpaid income.
Covered Arkansas wage access providers must state before each transaction and in their contracts that tips are voluntary and can be zero. Tips cannot affect access, payment amounts, or payment frequency; providers cannot mislead users about tips or claim they help a specific person or group. Providers cannot share fees or tips with employers, require credit reports or scores for eligibility, or accept repayment by credit or charge card. They cannot charge late fees, deferral fees, interest, or other nonpayment penalties, or collect through lawsuits, outside collectors, or sales to debt buyers. Providers also cannot use false or misleading ads or leave out facts needed to avoid misleading consumers.
Covered Arkansas wage access providers must follow federal electronic payment rules when collecting repayment from your bank account. They must refund the full overdraft or insufficient-funds fee caused by an attempted withdrawal before the disclosed date. The same refund rule applies when the attempted withdrawal differs from the disclosed amount. This protection does not cover payments you incurred through fraud or other unlawful means.
Arkansas's wage access protections do not cover every early pay service. They exclude earnings verifiers that have no contractual duty to fund payments and employers that directly pay workers early. They also exclude wage access providers that report consumer payment or nonpayment information to credit bureaus. Banks, savings and loan companies, and credit unions organized under state or federal banking laws are outside this framework. Users of these excluded services do not receive this act's protections through this framework.
