Commercial wind and solar facility owners must sign a farm restoration agreement with the landowner before construction. Construction includes site preparation, installation, and repairs. Covered land produces and sells at least $1,000 in farm products in a year, or normally meets that threshold. The landowner must have an ownership interest and be a party to the facility's construction agreement. The restoration agreement must set construction and removal standards for restoring the land after the facility's life. It must give the landowner a complete removal plan with adequate proof of financial backing and assurances. The agreement must be completed and sent to the Arkansas Department of Agriculture at least 45 days before the construction contract's full notice to proceed. It binds future facility owners and landowners, but the underlying contract can modify its terms. The law does not apply when the facility owner also owns the land. It also does not apply to or change underlying facility agreements signed before the law took effect.
Farm restoration agreements held by the Arkansas Department of Agriculture are not public records. The public cannot inspect or obtain them under the Arkansas Freedom of Information Act.
