Community disability homes lose rules and protections

Arkansas repeals its Location Act for community homes serving people with intellectual and developmental disabilities. This removes density, setback, and spacing rules, including 300-foot and 3,000-foot distance requirements in specified city settings. It also removes the Act’s licensing, planning, notice, health and safety, enforcement, and appeal rules. Homes also lose the Act’s protections treating certain single-family and multifamily homes as allowed residential uses. Housing access and remaining requirements depend on other laws and local practice. The related child welfare licensing exemption now covers only human development centers regulated by the Board of Developmental Disabilities Services.
