Arkansas law creates a Class B felony for knowingly giving a pregnant woman an abortion-inducing drug without her knowledge or consent. The person must act with the purpose of causing a chemical abortion. Covered drugs and substances include off-label uses of mifepristone, RU-486, Mifeprex, Cytotec, misoprostol, and methotrexate. The definition excludes medicines prescribed for other medical reasons that may raise miscarriage risk, such as chemotherapy or diagnostic drugs. It also excludes contraceptives, emergency contraceptives, and methotrexate used to treat an ectopic pregnancy. Prosecutors can bring additional charges under other laws if the drug causes death or bodily injury to the woman or an unborn child.
