Beginning January 1, 2026, covered Arkansas health plans must cover medically necessary care for brain injuries acquired after birth. This applies when plans are offered, issued, renewed, delivered, or extended in Arkansas. Covered care includes cognitive, communication, functional, and behavioral therapies; neuropsychological testing; neurofeedback; and inpatient and outpatient rehabilitation. It also includes day treatment, community reintegration, home and community services, and post-acute residential treatment. Plans cannot impose lifetime or unreasonable yearly limits on treatment days or sessions, charge higher cost sharing than other benefits, or reduce other benefits. Any inpatient rehabilitation cap must be listed separately from post-acute rehabilitation limits. Exclusions include dental- or vision-only, disability income, workers’ compensation, accident-only, hospital-indemnity, specified-disease, long-term-care-only, and state and public school employee plans. Credit insurance, certain liability supplements, and automobile or homeowners medical-payment coverage are also excluded. Only qualified brain injury specialists can conduct prior approval and treatment-use reviews, and the Insurance Commissioner must establish faster appeals of adverse decisions. Acute and post-acute rehabilitation providers must meet customary licensing, accreditation, training, and experience standards.
Arkansas’s Department of Human Services must seek a Medicaid waiver or add people with acquired brain injuries to an existing waiver. This pathway is for Arkansas Medicaid members who need home and community services for their brain injuries. Access depends on obtaining the waiver or adding these members to an existing waiver program. The law does not set a start date or dollar amount for these services.
