3 provisions identified: 0 benefits, 2 costs, 1 mixed.
To drive on locally designated roads, you need a valid driver's license and must follow its restrictions and traffic rules. You must register your utility task vehicle and display its registration decal on the driver's-side roll bar. You must maintain insurance meeting private passenger vehicle minimums and carry proof of coverage. Your vehicle needs at least two working headlamps, rear-facing turn signals, at least one brake light, and seatbelts. These requirements can mean registration fees, insurance premiums, and equipment costs; the law gives no dollar amounts. They apply to the new designated-road option, not automatically to every use allowed under existing exceptions.
A person convicted of violating Arkansas's ATV and utility task vehicle chapter is guilty of a Class C misdemeanor. This replaces the chapter's former stated fine and imprisonment terms. The amended provision does not list new fine amounts or sentence details.
Arkansas cities can open roads to utility task vehicles by ordinance; county judges can do so by executive order. Partial openings require an attached map and road list filed with the relevant clerk. Local governments cannot open roads posted above 55 mph, divided four-lane highways, or roads in state parks. State highways within designated areas are open unless excluded; the less restrictive designation controls where city and county authority overlap. Existing road-use exceptions remain available, separate from this new route to road access. A qualifying utility task vehicle is no wider than 80 inches and has at least four low-pressure tires. It must also have a steering wheel, non-straddle seating, rollover protection, and the ability to travel over unimproved terrain. ATVs, golf carts, riding lawnmowers, and lawn or garden tractors do not qualify. The law separates utility task vehicles from ATV and recreational off-highway vehicle rules.
