Arkansas towns get new attorney options

Arkansas second-class cities and incorporated towns can elect their attorney when other city officers are elected, unless an ordinance makes the office appointed. They can instead contract with a lawyer if they do not maintain an attorney's office. All these attorneys must be licensed in Arkansas. Elected and appointed attorneys serve four-year terms and generally must live within the city or town. If no lawyer lives there, or no resident lawyer has been elected, the mayor and council can appoint an outside lawyer. Contracted lawyers do not have to live there. Cities and towns can still join other municipalities to buy legal services. The law also repeals prior attorney rules for first-class mayor-council cities with fewer than 10,000 residents. It separately repeals attorney rules for mayor-council cities with fewer than 5,000 residents.
