Drug delivery brings broader homicide charges

Arkansas law adds misdemeanor offenses involving actual drug delivery as a basis for capital murder, first-degree murder, and manslaughter. The murder rules cover people acting alone or with others who commit or attempt the delivery offense. They or an accomplice must cause a death during and furthering the offense, or while immediately fleeing it. Murder charges require circumstances showing extreme indifference to human life. Manslaughter covers participants negligently causing a death during the offense or immediate flight, or someone resisting either causing a death. Mere possession is not added as a basis for these charges.
