Teachers face penalties for library rule violations
The school principal and district superintendent must document an allegation of a first violation of these library rules. They may suspend a teaching staff member found to have knowingly violated the rules for up to five days without pay. A second allegation must go to the Professional Licensure Standards Board through a formal complaint. The board may suspend the teaching license after a second knowing violation. After a third knowing violation, the board must revoke the teaching license.
Parents control access to restricted library materials
The law applies to libraries in Arkansas public elementary school buildings enrolling kindergarten through grade five. These libraries must keep non-age-appropriate sexual content in locked compartments within a designated area, including materials available to the public. Covered content includes explicit instruction, promotion, or advocacy of sexual ideology, behaviors, or orientations not developmentally appropriate for these grades. Enrolled students cannot view or check out these locked materials without prior written approval received by the library. Approval must come from a parent, legal guardian, or someone acting in place of a parent.
