Fines for breaking public electric-vehicle purchasing rules

A manufacturer or seller found to knowingly give false or misleading certification information triggers a civil fine against the manufacturer. That fine is the greater of $10,000 per false or misleading statement or half the government buyer’s total purchase price. A public entity found to knowingly break the purchasing rule pays the state the greater of $10,000 per false or misleading statement or the full purchase price. An employee found to knowingly break the rule personally owes the state $5,000. Each board member who votes to approve an electric-vehicle purchase found to break the rule also personally owes the state $5,000.

Forced-labor checks for government electric vehicles

Arkansas public buyers cannot buy electric vehicles or parts made wholly or partly with forced labor. This covers state agencies, local governments, school districts, public colleges, and other publicly operated entities. Manufacturers must provide a sworn, good-faith statement that no supplier used forced labor, including in parts production or material mining and sourcing. The rule covers vehicles powered to a significant extent by an electric motor using an externally rechargeable battery. It applies to contracts entered into, changed, or renewed on or after the law’s effective date, which the provided text does not specify.
