More tools for doctors challenging care denials

Arkansas care reviewers must give providers the deciding doctor's phone number and a backup doctor-to-doctor contact if unavailable. Notices must list the reviewing doctor's specialty, board certification or eligibility, and licensed states. Verbal notices must give the doctor's name and license number; written notices must give a number to obtain them. For denials questioning medical need, appropriateness, or experimental status, notices must provide contact with a doctor holding a current, unrestricted Arkansas license. That doctor must discuss the treatment plan and clinical basis and disclose their name and license information when contacted. If a provider sends the Arkansas State Insurance Department an audio recording proving a violation of these doctor-contact requirements, the request is deemed approved. The department must order the reviewer to issue approval immediately. Provider notices must also explain the clinical rules used, how they apply, access to reports, appeals, and consideration of supporting materials. They must give complaint addresses and phone numbers for the Arkansas State Medical Board, State Board of Health, and State Insurance Department. The insurance department contact requirement does not apply to self-insured government employee plans.

Clearer care denial explanations for patients

Arkansas care reviewers must send patients written denial notices in plain language. Notices must explain the clinical criteria and internal rules used, and how they apply to the patient's situation. They must explain how to get the review report, complete an appeal, and have supporting materials considered. Notices must include complaint addresses and phone numbers for the Arkansas State Medical Board, State Board of Health, and State Insurance Department. Reviewers must handle any subscriber request for prior approval information, including general questions, under these patient notice rules.
