Arkansas courts cannot permanently change custody or visitation solely because a parent is mobilized or has a first-responder work schedule. First responders include firefighters, emergency medical technicians, paramedics, and certified law enforcement officers. A mobilized parent is a military member called to active duty or ordered to serve outside the state or country. Covered forces include the Army, Navy, Marine Corps, Coast Guard, Air Force, National Guard, reserves, and other U.S. or Arkansas military branches and auxiliaries. Courts must decide whether temporary custody or visitation changes are appropriate for children of these parents. They must consider ways to maximize the parent's time and contact with the child, while protecting the child's best interests. For mobilized parents, courts consider duty length, duty stations, leave opportunities, past contact, the mission if known, and other relevant factors. Courts retain power to permanently change orders when a parent volunteers for permanent military duty as a career.
