The Arkansas Department of Agriculture takes over specified oversight duties for farm lime sold or distributed in Arkansas. Suppliers must register each material before sale, provide its guarantee statement, and pay $15 per material; registrations expire June 30. Department agents can take samples of at least two pounds and reasonably access production sites, stores, storage sites, and delivery vehicles. The Department can stop sales of unregistered, mislabeled, below-guarantee, or otherwise noncompliant materials. A manufacturer, importer, or guarantor owes twice the actual deficiency's value when official testing finds a deficiency of 5% or more. The consumer must receive payment within 30 days after notice, and payment receipts go to the Department. If the consumer cannot be found, deficiency and shortage payments go to the Department within 45 days for the Plant Board Fund. The State Plant Board keeps certain powers to refuse or cancel registrations, including for noncompliance and reporting violations.
Registered farm lime suppliers receive a Department of Agriculture invoice after filing their quarterly tonnage report, rather than paying with it. Sworn reports cover Arkansas distributions and are due within 30 days after September 30, December 31, March 31, and June 30. The charge stays 30 cents per ton or part of a ton; reports below one ton owe 30 cents. Of each per-ton charge, 20 cents supports Plant Board operations and improvements, and 10 cents supports University of Arkansas soil testing, fertility research, and extension. Department receipts must show both fund deposits. The university's trustees invest money not needed for current operations in state-authorized investments, with interest staying in the soil testing fund. The Department can inspect or audit manufacturers' and manipulators' books; refusing access violates the law. Late reporting or underreporting doubles the tonnage fee owed, with penalties going to the Plant Board Fund. For sales to a non-registrant through transactions involving registered suppliers, the selling registrant owes the inspection fee unless the initiating registrant pays; invoices must identify that responsibility.
