Seed growers pay certification and promotion costs

Seed inspection and certification applicants pay reasonable costs in advance; the Department of Agriculture invoices them when they apply. That money goes into a separate fund for the seed certification law. After a public hearing, the State Plant Board sets separate promotion and advertising charges by rule. The department bills the responsible party based on certified-seed acreage or the number of certified tags and labels sold. The money supports programs run by the Arkansas Seed Dealers’ Association and Arkansas Seed Growers Association, or their successors. Before collecting or raising promotion charges, the board must seek advice from the House and Senate agriculture committees. The law does not set dollar amounts for either charge.

Arkansas shifts oversight of seed growers

The Arkansas Department of Agriculture takes over most seed certification duties through its Plant Industries Division. At a grower's request, it checks seed variety purity and fitness for planting, then certifies seed that meets standards. The State Plant Board retains rules and seed classifications, including “Registered” and “Certified.” Applicants must show the character, skills, and facilities the department requires for growing and handling purebred seed. Each certified seed bag or container needs the proper tag or label; certificates last only one crop season. Using “certified” or “registered” to describe seed quality requires the proper certificate. False certification claims, misleading marks, tag misuse, false application statements, and violations of certification rules or agreements are criminal offenses. Each offense carries a $25 to $500 fine. Certificate revocation requires a hearing before the division director; holders can appeal to the board, whose decision is final. The department also oversees aflatoxin monitoring for Arkansas-grown grain and seed sold or distributed in the state. It can cooperate with other state and federal agencies.
