Arkansas savers gain protection from creditors

Arkansas law protects more savings accounts from court orders that seize money to pay debts. It protects rights to account assets and future payments, even before those rights are fully earned. Covered accounts include inherited retirement accounts and annuities, health savings accounts, 529 college savings plans, 529A disability savings plans, and Coverdell education accounts. The new protection covers plans outside the existing retirement exemption that are federally tax-exempt or defer tax until payment. It also includes plans taxed only under federal unrelated-business-income rules. The listed federal rules for those plans and education and disability accounts are those in effect on January 1, 2025. Existing protections continue for retirement plans, including qualifying self-employed, government, and church plans, under federal tax or retirement-benefit law. IRA contributions above the federal deductible amount, and their earnings, remain unprotected unless another law protects them. That exclusion does not apply to qualifying Roth IRAs.
