New sales rules for compounded drugs

The law allows outsourcing facilities that compound prescription drugs and controlled substances to sell products through specified Arkansas healthcare channels. Facilities must be FDA-registered under section 503B and hold an Arkansas State Board of Pharmacy permit. Buyers must be Arkansas-licensed retail pharmacies dispensing to patients, healthcare facilities treating patients, or healthcare providers administering products in medical clinics. Sales to wholesalers, pharmaceutical repackagers or relabelers, marketing firms, and other entities are barred, except for those allowed buyers. Facilities must follow federal manufacturing standards in 21 C.F.R. Parts 210, 211, and 212 as they existed on January 1, 2025. The pharmacy board must adopt rules requiring retail pharmacies to educate patients about these compounds and identify the facility that prepared them. The board may require additional items it considers necessary.
