The law requires avoiding a net loss of hunting habitat acreage, as far as practicable, compared with January 1, 2025. This covers Commission-managed land, including private owners' closure decisions. The calculation excludes Commission-owned acreage under private contracts and leased acreage lost when leases or agreements expire or end. When hunting land closes, the Commission must quickly identify replacement acreage to offset the closure. As far as possible, replacement land must be reasonably nearby and support the same type of hunting. No fixed replacement acreage or distance is specified. By July 1 each year, starting July 1, 2025, the Commission must report to the Arkansas House and Senate Committees on State Agencies and Governmental Affairs. Reports must list acres closed in the previous fiscal year, closure reasons, and acres opened to offset closures.
The Arkansas State Game and Fish Commission must generally keep its owned and qualifying leased lands open for recreational hunting. Qualifying leases or written agreements must give the Commission possession for at least one year and include public hunting rights. Hunting includes lawful trapping, capture, shooting, and related attempts. The Commission must promote hunting where lawful, but hunting does not take priority over other lawful uses. Existing rights and limits for safety, homeland security, wildlife management, and other legal purposes still apply. Private owners retain lawful access decisions on their privately owned Commission-managed land. The law does not require National Park Service parks or monuments to open for hunting.
