Privacy protections for casino opt-out members
Information on the self-exclusion list is confidential and not open to public inspection. It cannot be released under Arkansas’s Freedom of Information Act. The Commission and participating entities cannot disclose your name or information without your permission.
Limited claims when casinos disclose identities
Casinos and their employees generally are not liable for harm caused by disclosing or publishing a self-excluded person’s identity. This applies to harm suffered by the listed person or someone else. The protection does not cover disclosure that is both willful and unlawful.
Listed gamblers lose winnings and recovery rights
If you are self-excluded, you cannot collect winnings or recover losses from prohibited casino gambling. Gambling that gives you money or value is treated as a completed transaction. Money or value you receive or are owed from casino wagers made while listed is subject to forfeiture. You must get notice and a chance for a hearing before forfeiture. Forfeited amounts go to Arkansas’s General Revenue Fund.
Statewide casino opt-out with identity checks
Self-exclusion means asking a casino to keep you from entering its facility. The Arkansas Racing Commission may keep a statewide list, at its Director’s discretion. That list replaces separate casino lists for meeting self-exclusion duties. If maintained, the Commission must join a multi-state or national program or agree with other states to share and enforce lists. You can enroll only yourself, and casinos must check your identification first. Commission rules must cover the move from single-casino lists and a process for removing yourself. Rules must also let people choose which state receives their listing and enroll in multiple states with one form. Implementation costs may come from casino assessments or money forfeited under Arkansas’s 2018 casino gaming amendment.
