Shared real estate agents: choices and limits

In Arkansas, a real estate agent can represent multiple clients when all clients consent to dual agency. Those clients can agree by contract to waive the agent’s main loyalty duty, only as allowed for that shared representation. Contracts can also limit sharing of private information, including information that could seriously weaken a client’s negotiating position. Those privacy limits do not block disclosure required by law or approved by the client in writing. Agents still must use reasonable care, follow their agreements, disclose material facts that are not confidential, and account for clients’ money and property. Outside the allowed dual-agency exceptions, clients cannot waive the law’s required duties.
