New valuation rules for affordable housing properties

Arkansas’s Assessment Coordination Division must set fair property assessment rules that account for government rent limits, operating requirements, and other restrictions. Covered properties must have restrictions tied to federal low-income housing tax credit eligibility, construction using HUD’s HOME program, or construction using USDA incentives under 42 U.S.C. § 1485. The division must submit proposed rules early enough for Legislative Council review before January 1, 2026. Initial final rules must be filed with the Secretary of State by January 1, 2026. If required legislative approval is not complete by then, filing must occur as soon as practicable after approval. The law does not set a valuation formula or guarantee lower property taxes or rents.
