Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 1 costs, 1 mixed.

Legal protection for approved nutrient users

An approved nutrient management or poultry litter management plan serves as a permit for nutrient applications that follow the plan. Those applications cannot be the basis for civil or criminal liability for plan holders, their agents, or their principals. This protection covers both direct liability and liability for another person's actions. Approval must come from the relevant authority. The plan cannot have been revoked, rescinded, or replaced by a newer plan.

Fewer lawsuit options over nutrient violations

Administrative violations of the nutrient management and poultry litter management sections cannot be the basis for civil or criminal action. Alleged violations do not create a private right to sue or support other actions beyond enforcing plan terms. Enforcement of those terms remains allowed. The state commission can still collect authorized administrative fines.

Limits on nutrient use protect water

Covered nutrient applications in Arkansas nutrient surplus areas must follow limits on when, where, and how nutrients are applied. The state commission sets these limits in the applicable nutrient management or poultry litter management plan. These rules aim to protect soil fertility, crop health, and state waters while restricting nutrient users.
