Arkansas voters can recall school board members

Arkansas law creates a process for voters to remove a school board member through a recall election. Removal requires a majority vote of voters qualified to vote for that member’s office. Reasons for recall include a moral failing leading to pending criminal charges or loss of public trust. Other reasons are also allowed. The petition must name the member, identify the office, request a recall election, and explain the reason for removal. It must include a petitioner’s sworn statement that the reason is truthful. Signers must provide their legal names and home addresses. Signatures must come from at least 35% of voters qualified to vote for that office. The county clerk checks signatures within 10 days of filing. If signatures reach 35% when filed but fall below 35% after checking, petitioners get 10 more days to gather signatures. Once enough valid signatures are verified, the clerk certifies the petition and notifies the school board and county election commissioners. The recall vote takes place at the next school board election at least 60 days after certification. If the upcoming election is sooner, the recall waits until the following school board election. Only one recall petition is allowed against a member during that member’s elected term. Removal creates a vacancy filled under state vacancy rules, but the removed member cannot be appointed to fill it.
