Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 3 costs, 0 mixed.

Petition canvassers face eligibility and pay limits

Arkansas local option petition canvassers must be U.S. citizens and Arkansas residents. Paying, offering, accepting, or agreeing to accept pay tied to the number of signatures collected is illegal. Pay for circulating petitions remains allowed when its amount or level does not depend on the signature count. Signatures collected in violation of the pay rule are void and cannot count. Violating that rule is a Class A misdemeanor.

Petition organizers face stricter signature checks

Arkansas local option petitions must use the county clerk’s signature-section format and the same number of lines as statewide petitions. County clerks cannot count signatures obtained or submitted incorrectly under the paid-canvasser rules. A petition part and all its signatures cannot count if canvasser information is missing, the canvasser fails requirements, or multiple canvassers sign. A canvasser commits a Class D felony by knowingly letting another canvasser falsely swear they witnessed every signature on a petition part. Sponsors, agents, and representatives commit a Class D felony by knowingly paying a canvasser for signatures on a part they did not personally witness. They also commit that felony by knowingly submitting a petition part whose verifying canvasser did not witness every signature.

Petition sponsors must screen paid canvassers

Arkansas local option petition sponsors must screen anyone paid or promised money or something of value to seek or collect signatures. This applies whether payment is arranged before or after signature gathering. Before anyone seeks signatures, sponsors must explain the law and file each paid canvasser’s name, home address, and sworn statement with the county clerk. Canvassers must provide identifying information, acknowledge the law, and provide a photo taken within the previous 90 days. Their sworn statements must disclose guilty or no-contest pleas and guilty findings for disqualifying offenses in covered U.S. jurisdictions. Sponsors must pay for and review Arkansas State Police criminal-history checks obtained within 30 days before canvassing begins. They must check the status of open or pending disqualifying charges and certify that each canvasser has no disqualifying offense. Sponsors must update their canvasser lists, file a final list and signature cards with the petition, and keep records for three years after the general election. Sponsors bear the burden of proving no disqualifying offenses in administrative or court proceedings. A willful violation is a Class A misdemeanor.
