Arkansas providers must give patients or authorized people requested medical record copies in paper or electronic form, unless federal law says otherwise. The law does not set a fee or guarantee the requester's choice of format. A paper copy made from an electronic record counts as an original when provided to patients or authorized people. It also counts as an original in agency or court proceedings. These rules cover full records, relevant portions, and summaries, including mental health records.
Arkansas healthcare professionals and facilities can choose to create, keep, send, receive, and store medical records electronically. They can convert records temporarily or permanently, without keeping separate paper copies. Electronic records must stay readable, retrievable, and adequately backed up; federal privacy and security laws still apply. Health plans, pharmacy benefit managers, and other health-benefit third parties must accept electronic records when auditing providers. Federal law can override this audit requirement.
