The law counts qualifying childcare work as school employment for access to the Arkansas Teacher Retirement System. Workers must teach, provide early childhood education, or supervise children enrolled at a licensed childcare facility. Their employer must be licensed and regulated by the Department of Education as an appropriate early childhood program. The employer must also receive state or federal childcare funding through that department. Participation is voluntary and requires retirement board authorization under existing membership rules; one board-approved nonprofit can handle the money transfers. Workers are not entitled to contributions from state funds or matching contributions from the state or retirement system. The retirement board must issue rules to carry out this pathway.
