County workers stay paid during budget delays
If an Arkansas county misses the January 1 budget deadline, last year's spending plan automatically takes effect again. It includes amendments passed by December 31, keeps final approved spending limits, and starts recorded spending at zero. County expenses, including most employee salaries, continue under those limits until a new budget is adopted. This applies even if last year's spending plan is found invalid. The emergency clause makes the law effective upon Governor approval, expiration of the veto period without action, or final veto override.
County officials lose pay during budget delays
If an Arkansas county misses the January 1 budget deadline, the county judge's salary is not paid. Justices of the peace also lose their per-day compensation until a new annual budget is adopted. A later budget cannot authorize either type of pay for the period covered by the automatically renewed prior-year budget.
Municipal spending continues with new purchase limits
Arkansas municipalities must adopt a budget by February 1 each year. If no budget is adopted by January 1, last year's budget applies until a new one is adopted. It includes amendments passed by ordinance by December 31, but spending is limited to necessary operations. Covered costs include regular services, public health and safety, payroll and benefits at December 31 levels, existing contract payments due, and outstanding debt or bond payments, including interest. Municipalities cannot use last year's approval to make a new capital purchase, such as major equipment.
