Beginning July 1, 2025, the Arkansas Public Defender Commission can use up to $233,629 for juvenile resentencing costs. The money comes from the Development and Enhancement Fund's remaining appropriation under Act 105 of 2024. It pays only for expenses related to resentencing juveniles sentenced to mandatory life without parole, not direct household payments. Contracts and obligations cannot exceed money actually available in the State Treasury. Grants, donations, federal funds, and other uncommitted agency funds can supplement that money. The agency cannot use its legislative funding for maintenance and general operations for this purpose. Spending must follow state purchasing, accounting, budget, and fiscal-control rules unless another law provides otherwise. It must also match the purposes documented in state budget materials and official legislative records.
