Petition collectors face limits and exceptions
Arkansas initiative and referendum petition collectors must file a truthful sworn statement before the Secretary of State counts their signatures. It must certify compliance during the current election cycle with the Arkansas Constitution and laws on canvassing, perjury, forgery, and fraudulent signature collection. The statement does not prove whether signatures are genuine or false. Death or medical disability that prevents filing does not disqualify collected signatures. That exception does not waive the separate affidavit required by Arkansas Code § 7-9-109. After filing, collectors cannot gather more signatures unless the Secretary of State finds the sponsor eligible to amend the petition under Article 5 of the Arkansas Constitution. The emergency clause makes the law effective upon governor approval, expiration of the veto period without action, or final veto override. If one provision is ruled invalid, the others remain in effect.
