Bill Overview

Analyzed Economic Effects

5 provisions identified: 5 benefits, 0 costs, 0 mixed.

Families can file childbirth injury claims

A child or their representative has until the child's fifth birthday to file a claim for medical injury during childbirth. For other medical injuries at age 9 or younger, the usual deadline is the later of the eleventh birthday or two years after the act. If an injury was unknown and could not have been discovered earlier, a separate deadline applies. It is the earlier of two years after discovery or knowledge of the injury, or the child's nineteenth birthday. These filing rules do not guarantee compensation.

Faster Medicaid access for pregnant applicants

Arkansas Medicaid must make initial eligibility decisions for pregnant applicants so eligible women can get prenatal care sooner. This temporary coverage allows care while the full application is processed. Medicaid can appoint qualified groups to screen applicants and enroll them right away.

Medicaid supports pregnancy and postpartum care

Arkansas Medicaid must pay for depression screening during pregnancy, keeping the requirement in the new maternal health law. It must also pay doulas and community health workers for home visits before or after birth. Pregnant and postpartum patients get coverage for medically needed, validated blood pressure devices, including replacement cuffs, to diagnose or treat high blood pressure. Coverage includes training to set up and use the devices. It also covers collecting readings for a provider to create or change a treatment plan.

Medicaid covers medically needed remote ultrasounds

Arkansas Medicaid must pay for medically needed remote ultrasounds using established medical billing codes. This applies to both fee-for-service coverage and managed care plans. Patients must be at home or another location away from the provider, and the same care standards must apply. The technology must securely send patient data to a provider elsewhere for interpretation and recommendations. It must have FDA approval and follow HIPAA privacy rules as they existed on January 1, 2025.

Medicaid pays separately for maternity services

Arkansas Medicaid must pay separately for prenatal, delivery, and postpartum services instead of one combined maternity payment. Listed services include office visits, lab fees, doctor-ordered testing, blood work, remote monitoring, and fetal nonstress tests. They also include medically needed continuous glucose monitors and other services for gestational diabetes. The payment change does not alter coverage through Arkansas Health and Opportunity for Me or risk-based provider organizations. The Department of Human Services must adopt rules and seek needed federal waivers or amendments to implement the maternal health requirements.
