Paid family-death leave for Arkansas public employees
Eligible Arkansas public employees can receive up to 40 hours of paid family-death leave per calendar year. The catastrophic leave program administrator must choose to grant it. Employees must use the leave within four weeks after the death. Qualifying service includes at least one year of state employment or prior public-school or state-supported college employment. Employees with less than one year of school or college service can combine it with state service. Their combined service must exceed one year, with a job gap under six months. Employees need acceptable proof of the death and no leave-abuse discipline during the prior year. The program generally requires 80 hours of combined sick and annual leave when the qualifying event begins. An agency director or institution president can waive that minimum for extraordinary circumstances under state standards. Employees do not need to use up their sick or annual leave before receiving this death-related leave. Covered family includes parents, siblings, spouses, children, grandparents, grandchildren, in-laws, and someone acting as the employee’s parent or guardian. Children include biological, unborn, step-, adopted, and foster children placed in the employee’s home. After the initial 40 hours, employees can use accrued sick leave. This paid leave runs alongside federal Family and Medical Leave Act leave when applicable. Employees earn no sick or annual leave while using catastrophic leave. Unused death-related hours do not carry over or get paid out when employees leave or retire.
