6 provisions identified: 3 benefits, 2 costs, 1 mixed.
The Arkansas Board can accept a gas transport driver’s transportation and delivery employee certification from a reciprocal state. That state’s certification requirements must be substantially equivalent to the Arkansas Board’s requirements. Acceptance is allowed, not automatic.
Applicants for Class Two, Three, Five, and Ten gas permits no longer need the specified certified or notarized financial statement. The repealed requirement called for a statement prepared within the preceding 60 days. This removes that document requirement, not the permit requirement.
The Arkansas Liquefied Petroleum Gas Board can make rules to carry out its duties. It can adopt all or part of National Fire Protection Association standards through rulemaking. The law does not itself adopt any specific standards.
Beginning April 1, 2026, retail gas sellers no longer must send monthly statements to customers with credits of $20 or more. The repealed rule required statements within the first 20 days of each month. The law also removes related Board monitoring and grounds for suspending or revoking a seller’s license or permit. It does not reduce or cancel customers’ credit balances.
Beginning April 1, 2026, the law repeals several Arkansas safety requirements for liquefied petroleum gas. These include the approved warning-odor requirement and limits on gas vapor pressure based on container ratings. It also removes minimum strength rules for butane and propane transport and storage containers; refrigerated or cryogenic containers were excluded. The Board’s specific duty to set extra safety standards for containers, systems, appliances, and related equipment also ends. These repeals do not establish that all other safety rules end.
The Board can require initial, recurring, and annual training for employees of all liquefied petroleum gas permit holders. When required, proof of training must accompany annual permit renewals. Certified employees who miss required training can have their certification suspended or revoked. Beginning April 1, 2026, dealers no longer must hold the separate safety meeting required every 12 months. Starting that date, Class One applicants’ listed owners, managers, officials, and employees must attend initial training before the application’s Board hearing. This replaces the former 40-hour basic course requirement; the new course length is not stated.
