Arkansas's Division of Labor must investigate every unpaid-wage complaint for legal violations, and its Director can sue to recover wages owed. Reviews cover the two years before filing and can extend through the assessment notice when an enforceable violation hinders the investigation. Filing pauses the Director's legal deadline until a final order decides the claim. The Director then has one year to sue for wages, liquidated damages, or civil penalties; this is not an employee filing deadline. When an enforceable violation hides a valid wage claim, the employee can be added at a reasonable time before the hearing, or the Director can issue a separate assessment notice.
