Gift card fraud brings new criminal penalties

Arkansas law creates the crime of gift card fraud. It covers acquiring or keeping cards or redemption codes with intent to defraud and deprive the owner of property. It also covers obtaining them by deceiving a card holder or issuer to deprive the owner of property. Knowingly using cards or codes obtained through either offense to get money, goods, services, or other value is also a crime. Covered cards are prepaid physical or electronic cards for one merchant or affiliated merchants sharing a name, mark, or logo. They may be reloadable. Charges depend on value: Class B felony for $25,000 or more; Class C felony for more than $5,000 but less than $25,000; Class D felony for more than $1,000 but less than $5,000; and Class A misdemeanor for less than $1,000. The listed ranges do not assign a class at exactly $1,000 or $5,000. Values from multiple violations within 120 days are added together. Value means the owner's greatest reasonable potential loss, including full face value or potential value for variable-load cards. The emergency clause makes the law effective upon Governor approval, expiration of the veto period without action, or the final chamber's veto override.
