Contractors face new rules for payment claims

Arkansas contractors who break licensing rules can seek payment for work through unjust-enrichment or quantum-meruit claims. They must pay all fines assessed by the Arkansas Contractors Licensing Board on time. They must also properly apply to the board for a contractor’s license. The law adds unjust-enrichment claims but replaces the prior quantum-meruit allowance with these conditions. Contractors still cannot sue to enforce contracts made in violation of contractor law.
