Arkansas public-record keepers must protect the personal information of railroad crew members involved in a railroad fatality. They must remove that personal information from records released to the public. Exceptions allow access for the host or employing railroad, court-authorized people, law enforcement officers, Arkansas state attorneys, and Arkansas transportation department staff. Court-authorized people and these state officials may access the information only when needed for their duties. Access is also allowed for the National Transportation Safety Board or a U.S. Department of Transportation agency investigating railroad accidents or incidents under its mandate. All requests under these exceptions must be written or electronic.
