School staff protected when confiscating vapes

Arkansas law protects school employees, law enforcement officers, and people with trust or authority over someone under 21 from civil liability. This protection covers taking nicotine, tobacco products, alternative nicotine products, vapes, e-liquids, or cigarette papers from that person at school. It also covers items they reasonably believe are vapes, and e-liquids without nicotine. School includes public, private, and charter schools, their grounds and vehicles, and off-campus school-sponsored or school-sanctioned K–12 events. The protection does not cover taking medication or medical devices, such as asthma inhalers. Alternative nicotine products exclude tobacco, vapes, and federally defined drugs, devices, and combination medical products. Vapes exclude FDA-regulated drugs and devices. These federal classifications are based on January 1, 2025, not the law’s effective date.
