Bill Overview

Analyzed Economic Effects

4 provisions identified: 1 benefits, 3 costs, 0 mixed.

Public workers face firing and five-year bans

A state or local official, agent, worker, or representative who violates this law must be terminated from that government entity. The person also cannot hold public office or obtain state employment for five years.

Arkansas protects qualifying diesel engine use

Qualifying diesel engines run only in Arkansas and do not require diesel exhaust fluid. Arkansas law protects the right to make, sell, install, use, and operate these engines within the state. State and local agencies, officials, and workers cannot restrict their production, sale, or use. They also cannot enforce or attempt to enforce federal diesel rules that block these rights or require that fluid. This restriction on state enforcement does not make federal rules invalid generally.

Government violators face fines and enforcement suspensions

State entities that break this law face civil penalties of up to $5,000 for each violation. State entities include state agencies, local governments, and their officials, agents, workers, and representatives. A violating agency or local government immediately loses authority to enforce state vehicle-emissions laws or rules for at least 12 months.

Engine sellers face labels and export limits

An exempt diesel engine made and sold exclusively in Arkansas must clearly carry a label for Arkansas-only use. These engines operate only in Arkansas and do not require diesel exhaust fluid. Export for use in another state is barred unless the engine complies with applicable federal laws.
