Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 1 costs, 1 mixed.

More youths face juvenile court cases

Arkansas expands delinquency cases for people age 10 or older, including crimes and offenses only juveniles can commit. Covered acts include school-employee cyberbullying and offenses assigned extended juvenile jurisdiction, replacing the prior capital-murder and murder framework. Traffic and game-and-fish violations are excluded unless they fit another listed category. People can still be found delinquent after reaching adulthood for offenses committed at ages 10 through 17. Courts also retain authority over people classified before 18 as delinquent, needing services, dependent, or dependent-neglected when juvenile-court jurisdiction continues.

Youth placement limits and protections change

The amended commitment provision removes its stated 21st-birthday limit for placement with Arkansas's Division of Youth Services. That provision supplies no replacement maximum and does not establish how long an individual placement lasts. Courts cannot send a juvenile to youth services solely for criminal contempt. Commitment orders must state that the juvenile was found delinquent and include the facts behind that finding.
