Driver license photos have limits and fees

Arkansas Driver Services can release a digital license photo when the person pictured requests it in writing and names the recipient. Each photo provided through that request route costs $5. A federal, state, or local court order or valid subpoena can also require release. Federal, state, or local law enforcement agencies can request photos for official work. The $5 fee applies only to the person's written-request route, not every release.

More driver privacy, less public record access

Arkansas ends general public inspection of driver and vehicle registration records and repeals the driver abstract-on-request requirement. Drivers and registered owners retain access to their records and can authorize someone else in writing. Courts can get records for civil, criminal, administrative, or arbitration proceedings; attorneys need a properly issued court subpoena. Government and law enforcement agencies can get records for official work. Employers need the driver's written consent to get driver records. Arkansas-licensed insurers and their agents, employees, or contractors can get driver records for insureds, applicants, and all licensed household drivers. Recipients can share driver records again only for uses allowed by state law. Registration lists can be sold, shared, or used only for safety recalls, federal or state agency programs, research that does not identify people, or purposes allowed by the federal Driver’s Privacy Protection Act as it stood on January 1, 2025.
