Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 2 costs, 0 mixed.

Lower trust fund fees for sewage facilities

New nonmunicipal sewage facilities pay an initial trust fund fee of 8% of estimated construction costs, down from 10%. For modifications, the 8% fee applies only to the modification’s estimated construction cost. Each fee is capped at $100,000, and the engineer of record must certify the cost estimate. Arkansas may reduce the fee when a facility faces enforcement and approved corrective work requires an initial contribution. Annual contributions stop when the fund reaches at least $2.1 million and resume when it falls to $1.5 million or less.

Tighter permit limits for sewage facilities

Arkansas cannot consider new or increased-flow permits for nonmunicipal sewage facilities within five miles of a public sewer collection system. Exceptions cover a significant pollution threat or a feasibility study showing no workable, cost-effective connection to the public system. After January 1, 2018, the agency cannot issue, renew, or transfer coverage to homeowners’ or property owners’ associations. That ban has exceptions under Arkansas Code § 8-4-203(b)(1)(C)(vi) and (b)(1)(E)(iii). Associations with coverage before 2018 can keep it only by complying with the section’s requirements.

Sewage permit renewals and financial backing

For facilities that made an initial trust fund contribution, the fee-related milestone moves from the third permit renewal to the second. The supplied provisions do not specify the fee result at that milestone. The law also removes expired rules allowing reductions or waivers of required financial backing for nonmunicipal sewage permits.
