Hospitals must explain patients' pharmacy choice

Hospitals with retail pharmacy permits that participate in the 340B Drug Pricing Program must explain eligible patients' pharmacy choice. This notice applies to 340B-eligible patients seeking medicines, supplies, or pharmacy services when leaving hospital care. It covers discharge from an emergency department, inpatient hospital, or hospital outpatient clinic. Hospitals must tell these patients they can obtain those supplies and services from the pharmacy they choose.

Hospitals can now run retail pharmacies

Arkansas removes the ban on nonprofit, tax-exempt, or government-funded hospitals holding retail pharmacy permits. These hospitals must have a state hospital license and employ a licensed pharmacist-in-charge under pharmacy board rules. The law provides one retail permit per hospital pharmaceutical services permit and one per 100 licensed hospital beds. Pharmacies under this formula must be within 250 yards of the hospital campus. The campus includes related buildings and areas that are not directly connected, but excludes parking lots and public-use parcels. This formula does not limit hospital ownership, operation, or permits for outpatient infusion facilities, including home infusion services, or freestanding community pharmacies serving network needs. The pharmacy board must report monthly to the Legislative Council on applications received and approved for each permit type: pharmacy, specialty, hospital pharmaceutical services, ambulatory care center pharmacy, and retail pharmacy. Reports must also include total licensed retail pharmacies and retail pharmacy closings statewide.
