Pharmacies gain lawsuit rights over pricing violations

Arkansas pharmacies, pharmacists, and pharmacy-service businesses can sue over violations of the state's maximum allowable cost list rules. They can seek compensation for harm, actual financial losses, and punitive damages meant to punish wrongdoing. Claims can use the Deceptive Trade Practices Act, Arkansas Pharmacy Benefits Manager Licensure Act, or Trade Practices Act. Winning plaintiffs can recover attorney's fees and all costs of pursuing the case. Under the Trade Practices Act, they can also recover $10,000 per violation. These lawsuits cannot target a government, government agency, or government official.
