Arkansas circuit courts can cancel bond actions for open-meeting violations only within 30 days after the action. For violations found later, the governing body must fix them within 30 days after the court’s finding. It must give required public notice, disclose the violation at a public meeting, and approve the action at a compliant public meeting. If it misses that deadline, each member found responsible must pay a $1,000 penalty to the person bringing the claim. Payment is due within 30 days of the court’s finding, and public money cannot cover it. These remedies add to other remedies available within legal filing deadlines. The rules cover bonds and other debt instruments, including short-term financing under Arkansas Constitution Amendment 78. The law makes these rules effective only if Arkansas’s 2025 SB227 becomes law.
