The law provides water and sewer treatment grants from the Securities Reserve Fund after other transfers authorized by lawmakers. It preserves at least $100,000 and transfers the lesser of the available balance or $25 million on each date: September 1, 2025; July 2, 2026; and July 1, 2027. This allows up to $75 million across the three transfers, with grant money held in a sub-fund as needed. Any balance left goes to the General Revenue Allotment Reserve Fund. For fiscal years starting July 1, 2028, or later, remaining money goes there on the fiscal year's last business day, without the earlier water-grant allocation.
Starting July 1, 2025, Arkansas moves certified, unused state money and other authorized revenues into the Restricted Reserve Fund. Sources include named set-asides, qualifying reserve balances, recovered general revenues, and estate-tax revenues credited to the Development and Enhancement Fund. Development and Enhancement Fund balances measured June 30, 2025, exclude money needed for approved projects or already reallocated. Qualifying general revenue reserve balances exclude money needed for applicable laws passed by the 95th General Assembly. The fund can pay legally approved appropriations, including those not listed in this law; these provisions specify no total transfer amount or direct household payment.
Starting July 1, 2025, reserve transfers require checks that protect approved uses of public money. Legislative approval comes from the Legislative Council, or the Joint Budget Committee during a legislative session. Before money leaves the reserve, the Chief Fiscal Officer must confirm that the spending law's requirements are met. Recipients must file a funding plan when required and certify legally required matching money before a project starts. Arkansas Legislative Audit can audit recipients to check whether money served its approved purpose.
