Fee payers get first $32,000 refunded

The law requires the first $32,000 collected under the cited state law to go back to whoever paid the implementation fee. That is the total amount, not an amount promised to each payer. The law does not say how it is divided if several people or groups paid.

New grants for childhood disease research

The law creates a state fund for childhood cancer and rare childhood disease research. The fund receives money collected under state law, legislative appropriations, gifts, donations, and federal grants. It is continuously appropriated, does not lapse, and the director distributes its money each year. When appropriations or federal grants for this research reach at least $5 million, the director allocates fund money to Arizona nonprofit health care providers and research institutions conducting phase I trials. If additional appropriations or grants do not reach $5 million, money collected under the cited state law goes to qualifying Arizona nonprofits conducting clinical trials. Both paths allow collaboration with facilities outside Arizona. The commission sets trial criteria and reviews applications to help the director choose grants; recipients must use the money for the required research, even when combined with other funds. The fund may use no more than 10% of annual deposits for its administration. The director may use up to 4% of appropriated or grant money for administration, unless a federal grant contract says otherwise. The commission has at least seven members, holds open meetings with public testimony, and reports grant details each year by August 1, starting in 2027. Members serve five-year terms, receive no pay but may get expense reimbursement, and must step aside when they have a conflict.
