Cleanup parties get liability protection

Arizona's environmental agency can give qualifying cleanup parties a release from state liability. The party cannot already be liable or plan to buy the site, and the work must provide a public benefit without worsening contamination or creating a major health risk. The director must find that the party has the skills, money, and access needed. Before signing, the agency must publish notice at least 15 business days ahead and accept written comments. Arizona can settle without formally finding an immediate, serious danger to health, welfare, state waters, or the environment.

More options for cleaning contaminated sites

The law recognizes cleanup using local microbes and other naturally occurring microbes that do not cause disease or take advantage of weakened hosts. Cleanup plans can also include community information, public participation, and an alternative drinking water supply.
