Beginning July 1, 2026, the Arizona Attorney General must enforce the advertising rules. After notice from the health department or Attorney General's Office, covered businesses and paraphernalia sellers have 14 days to comply. For a billboard within the 1,000-foot buffer, an advertiser has 30 days after Attorney General notice to comply. If events beyond the operator's control prevent timely removal, the billboard must come down as soon as safely and legally practicable. When the Attorney General finds that a marijuana establishment or nonprofit dispensary violated the rules, the health department can impose discipline under existing rules. Other people or entities that violate the section, including paraphernalia advertisers, face a $20,000 civil penalty per violation, paid to the Smart and Safe Arizona Fund.
Beginning July 1, 2026, marijuana businesses, nonprofit medical dispensaries, and paraphernalia sellers must follow new ad rules. Ads cannot target people under 21 or use child-appealing food brands, characters such as Santa, images of marijuana use, or potency and THC levels. Ads are barred at public airports and on public transportation. Online ads and sporting-event sponsorships need an audience that is at least 73.6% age 21 or older; sponsorships can also proceed with the sponsored group's written approval. Billboards cannot be within 1,000 feet of listed places, including schools, parks, churches, child care centers, and recovery facilities. Ads must include the warning, “Do not use marijuana if you are under twenty-one years of age or pregnant. Keep marijuana out of reach of children.” Printed warnings must cover at least 10% of the ad in black on white; billboard warning type must be at least 10% of the ad's largest type. Ads cannot make health claims known to be untrue. Platforms may host ads only with licensee authorization, the responsible business's name and license or registration number, and the required warning. Direct messages require age affirmation that the recipient is at least 21; messages only to established customers, or requested through an age-affirmed opt-in, are excluded from the ad definition.
