Easier total-loss paperwork for vehicle owners

For a total-loss settlement involving title or registration, a licensed insurer or its agent can send your power of attorney electronically to Arizona’s motor vehicle department without notarization. The director must approve the filing method. The document can be electronically signed and printed through a commercial product that checks identity at National Institute of Standards and Technology Level 2 or higher, without biometrics. A note near the signature must identify the identity check.

Lienholders can prove ownership after repossession

After default and repossession of a vehicle titled in Arizona or another state, the lienholder of record can use an affidavit stating that repossession followed default as proof of ownership, the right to possess the vehicle, and the right to transfer it. Financial-institution lienholders licensed in Arizona must submit these affidavits electronically to the motor vehicle department. This can make it easier to document and transfer a repossessed vehicle, which may affect the former owner’s claim.
