2 provisions identified: 1 benefits, 0 costs, 1 mixed.
When owners dispute how shared costs are split in a qualifying mixed-use condominium, the association must make relevant records available under state law. It cannot withhold a record that owners could otherwise access just because a lawsuit is pending.
In qualifying condominiums, costs that benefit only commercial or residential structures are charged only to that group’s units. Costs that benefit both groups are split between them, then divided among each group’s units. Commercial structures must have mostly commercial or work units, and residential structures must have mostly residential units; no homes can be above or below the commercial structure. After declarant control ends, a different cost split requires every unit owner’s agreement.
