Crypto owners face new state custody rules

Arizona treats virtual currency, cryptocurrency, and other digital-only assets with economic, ownership, or access rights as unclaimed property. An asset can be presumed abandoned three years after a message is returned undeliverable; documented owner activity or contact stops the clock. After reporting, holders must send assets in their original form to the state or a qualified custodian within 30 days. Holders without the keys needed to move an asset must keep it until those keys are available. At the Department’s direction, custodians may stake assets or receive airdrops; rewards from property still unclaimed go to the state reserve fund after three years. Custodians need an Arizona license to sell and hold digital assets and must fit one of the law’s listed organization types. Arizona must sell listed digital assets at the prevailing exchange price or higher; unlisted assets may be sold by a commercially reasonable method.

Arizona creates a fund for crypto rewards

The State Treasurer administers a fund for airdrops, staking rewards, and interest received as the unclaimed property law allows. Fund money is subject to legislative appropriation. With legislative approval, 10% of the digital assets in the fund may go to the state general fund, but bitcoin cannot be deposited there.
